Kaiser and The Permanente Sanctions, Fines and Audits as a result of numerous investigations by Government Agencies
This section is by no means complete but is added to as time provides.  

Kaiser seems to have more fines and sanctions levied against it, an average sized HMO than any other in the entire country.  No government agency; No legislator;  No one in a position to stop the carnage appears to care because they do nothing to stop it.

Kaiser on average pays the State of California Department of Managed Health Care a little over $1,000,000.00 per year in fines and has since that department was created in 2000.

"Review of Vendor Rebates Paid to Hospitals-Kaiser Foundation Hospitals and Health Plans, Inc., Oakland, California (A-05-07-00051)

The objective of the review was to determine whether Kaiser Foundation Hospitals and Health Plans, Inc. (the provider) reduced costs reported on its fiscal year 2003 Medicare cost report by the $35,438 vendor rebate it received.  The provider did not reduce costs reported on its fiscal year 2003 Medicare cost report by the $35,438 rebate, contrary to Federal regulations and CMS guidance.

...recommended that the provider (1) revise and resubmit its 2003 Medicare cost report, if not already settled, to properly reflect the $35,438 rebate as a credit reducing its health care costs and (2) consider performing a self-assessment of its internal controls to ensure that future vendor rebates are properly credited on its Medicare cost reports.  The provider agreed

April 15, 2003 Kaiser Foundation Hospital –Sunset, Los Angeles, California, agreed to pay $20,000 to resolve its liability for CMPs under the patient dumping statute. The OIG alleged that Kaiser was a hospital that had specialized capabilities or facilities that refused to accept the transfer from another hospital of an 83-year-old patient needing Kaiser’s capabilities for coronary bypass surgery. The OIG alleged that Kaiser’s cardiac surgeon refused to accept the transfer saying that the patient was too unstable to transfer and that he was going to die anyway. The patient was transferred to another hospital where he underwent successful surgery and was discharged.

Department of Health and Human Services - October 25, 2007 Survey report on Kaiser Foundation Hospital Fresno.  The Kaiser plan of correction was denied by CMS as of February 1, 2008.  A new Plan of Correction by Kaiser is due to CMS by February 8, 2008.

LOS ANGELES -- Kaiser Permanente will be assessed a record fine Thursday for its haphazard investigations of questionable care, physician performance and patient complaints at its California hospitals, state HMO regulators said Wednesday.

The California Department of Managed Health Care said it will levy a $3 million fine against Kaiser, the largest health maintenance organization in the state, with 29 medical centers and more than 6 million members. If Kaiser makes necessary improvements, agency director Cindy Ehnes said, she will forgive $1 million of that.

CNA received written notice from the DHS that they had issued another Statement of Deficiencies (SOD) against Kaiser-Sacramento (Morse Ave.) facility for their improper use of unlicensed surgical technicians. Kaiser was using the unlicensed technicians as first assistants during orthopedic procedures. Nurses reported numerous eye-witness accounts of unlicensed technicians suturing, cutting tissue, using a bovie on vessels, and drilling pins and screws. The hospital was cited in 1996 for allowing the unlicensed technician to administer marcaine into the joints of patients in the OR.

a carrot1998 Kaiser Permanente Hospital in Santa Rosa has been cited by the state Department of Health Services for allowing a technician to perform medical procedures during orthopedic operations.

The Santa Rosa hospital is the third Kaiser facility to be cited by the state for using an unlicensed assistant during operations. Kaiser hospitals in Sacramento and in San Jose were also cited by the agency, which licenses and regulates the state's hospitals.

The investigation of Kaiser in Santa Rosa, conducted in June and completed Aug. 7, revealed that the hospital's four orthopedic surgeons were using an orthopedic assistant, who is a technician, to perform such procedures as suturing deep tissue wounds, placing pins in bones and cauterizing veins.

designee signs this Order. Payments shall be made by check or money order made payable to the Maryland Insurance Administration and include the case number or name. Payment should be sent to the attention of, Appeals Clerk, 525 St. Paul Place, Baltimore, MD 21202-2272.

Kaiser was overpaid $10,472 for 20 patients that they had reported as Institutionalized.  This was based on a quick check of 100 patients which were a random sample of 2,391 Medicare beneficiaries reported as Institutionalized.  Medicare determined that Kaiser overall was being overpaid $105,624 of patients incorrectly reported as being Institutionalized.  It was determined that part of the overpayment was related to the poor record keeping of Kaiser Permanente.  It was determined that Kaiser had been overpaid by at least $105,624 for patients Institutionalized.

Kaiser received Medicare overpayments of $11,214 for 15 beneficiaries.  The 15 beneficiaries were part of a statistical sample of 100 beneficiaries reported as institutionalized between January 1, 1996 and December 31, 1998.  Based on these sample results Medicare determined that Kaiser was overpaid $49,963.00  for beneficiaries incorrectly listed as institutionalized.  Kaiser was advised to only refund the $11,214.00 although they were advised to investigate themselves and if their figures agree with Medicare to return all the money.
